EXPRIA LLC TERMS AND CONDITIONS

1. Introduction
These Terms and Conditions ("Terms") govern your access to and use of the Expria LLC website and services, including our custom embroidery products and related offerings (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.
If you do not agree with any part of these Terms, you must not access or use our Services.
2. Services Description
2.1. Embroidery Products and Services
Expria LLC provides custom embroidery services, including but not limited to:
- Custom embroidered apparel (crewnecks, shirts, hats)
- Graduation stoles with cultural and personalized elements
- Embroidered patches
- Appliqué work
- Upcycled one-of-a-kind embroidered pieces
- Bulk embroidery orders for businesses
- Digitization services for embroidery designs
2.2. Handcrafted Nature of Products
All of our products are handcrafted by a single artisan. Each item is created with care, which influences our production times and policies. Due to the handmade nature of our work:
- Minor variations are part of the charm of handcrafted items.
- Production times vary based on complexity and current workload.
- Each item receives individual attention to ensure quality.
3. User Eligibility
Our Services are available to users of all ages. However, users under 18 years old may need parental or guardian assistance to complete purchases, as minors may have limited capacity to enter into contracts in some jurisdictions.
4. Ordering and Payment
4.1. Order Placement
By placing an order, you agree to provide accurate and complete information. For custom embroidery orders, you must provide clear specifications and approve designs before production. We reserve the right to refuse any order that violates our policies or that we are unable to fulfill.
4.2. Design Consultation and Approval Process
For custom orders, we provide free design consultations as part of your order. The design process is iterative:
- A digital mockup of your order design will be provided for your review.
- You must respond within 48 hours to approve or request minor adjustments.
- If no response is received within 48 hours, the design will be deemed approved.
- Major changes requested after mockup approval that alter core design elements will be considered substantial and may require a new order or additional fees.
4.3. Payment
Payment is due at the time of order placement unless other arrangements are explicitly agreed upon. We accept ACH, Apple Pay, Afterpay, Klarna, Link, Visa, Mastercard, American Express, Discover, Diners Club International, JCB, UnionPay, CB, PayPal, and Venmo. For custom or bulk orders, a deposit may be required before production begins. All prices are in US dollars unless otherwise specified.
4.4. Deposits
- Graduation stoles and certain custom orders require a non-refundable deposit, typically ranging from 30-50% of the total order value.
- Deposits secure your place in our production schedule and cover initial design work.
- The remaining balance must be paid before the item is shipped or delivered.
4.5. Order Cancellation and Refunds
- Pre-Production Cancellation:
If you need to cancel your order before any production work has begun, please notify us within 24 hours of order placement via our contact page. If cancellation is approved, you will receive a refund less a fixed processing fee of 10% of the order value to cover administrative and design preparation costs. - During-Production Cancellation:
Once production has begun, cancellation is not possible and deposits will be forfeited. - Expria LLC Cancellation:
In the rare event that we cancel your order due to circumstances on our end, you will receive a full refund.
4.6. Payment Disputes and Chargebacks
All payments are processed securely through trusted third-party providers. If you initiate a chargeback, you agree to provide evidence supporting your claim. We reserve the right to contest any chargeback deemed unwarranted. Repeated or fraudulent chargebacks may result in termination of your account and legal action.
5. Production Timeframes and Shipping
5.1. Production Times
- Standard products: Typically 1-3 weeks from order confirmation.
- Custom one-off orders: Typically 2-4 weeks from design approval.
- Bulk orders: Timeframe provided upon consultation based on quantity and complexity.
- Graduation stoles: Minimum 2 months lead time required due to their detailed handwork.
5.2. Shipping Methods
- We ship via UPS, USPS, and FedEx throughout the continental United States.
- Primary shipping areas include Texas, New Mexico, Oklahoma, and Colorado; however, we ship nationwide.
- Shipping options and estimated delivery times are provided during checkout.
- Actual delivery times may vary based on location and carrier operations.
5.3. International Shipping
- We do not regularly ship internationally. Special arrangements may be considered on a case-by-case basis.
- International customers are responsible for all customs fees, duties, and taxes.
5.4. Expedited Shipping
- Expedited shipping may be available for certain orders by special arrangement.
- Expedited shipping does not expedite production time unless specifically agreed upon.
- Additional fees apply for expedited shipping services.
5.5. Shipping Delays
Expria LLC is not responsible for shipping delays caused by carriers, customs, weather, or other factors beyond our control. For time-sensitive orders (e.g., graduation stoles), we recommend ordering well in advance of your event.
6. Intellectual Property
6.1. Expria LLC Content
All content on our website, including designs, logos, text, graphics, and images, is the property of Expria LLC or our licensors and is protected by copyright and other intellectual property laws.
6.2. Customer-Provided Content
For custom embroidery orders, you represent and warrant that you own or have proper licenses to use any designs, logos, or text you provide. You grant Expria LLC permission to reproduce your designs solely for the purpose of fulfilling your order. We reserve the right to refuse orders containing content that may infringe on third-party rights or that violates our policies.
6.3. Licensed Characters and Logos
We do not embroider licensed characters or logos without proper licensing in place. If your order requires use of licensed material, you must provide documentation of your right to use the material, or the project must be licensed through appropriate channels. We may create designs inspired by certain themes, but we do not create counterfeit or infringing products.
6.4. Portfolio Rights
With your permission, we may photograph your completed custom work for our portfolio and social media. You will be asked for consent before any images of your custom order are shared publicly. You may revoke this permission at any time for future use.
7. Graduation Stole Special Considerations
7.1. Lead Time Requirements
All graduation stole orders require a minimum of 2 months lead time before the graduation date. Orders placed with insufficient lead time will be declined or may incur substantial rush fees, if possible. No exceptions will be made during peak graduation seasons.
7.2. Customization Process
Each graduation stole is meticulously handcrafted with hand-beaded elements. The process includes fabric selection (from approximately 8+ options), digitization, embroidery, sewing edge décor, and hand-beading. Due to this detailed process, stoles cannot be rushed without compromising quality.
7.3. Design Approval
All graduation stole designs require explicit approval before production. Once approved, changes may not be possible due to the production timeline. Cultural elements are created with respect and attention to detail.
8. Return Policy
Our complete Return Policy is available here. Key points include:
- Due to the custom nature of embroidery, all sales are generally final.
- Exceptions may be made for damaged or defective items, as detailed in our Return Policy.
- We do not offer refunds for custom work unless the error was made by Expria LLC.
9. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
While we strive to create high-quality embroidered products, we do not provide formal warranties or guarantees on our work due to the nature of our business as a small operation.
10. Limitation of Liability
IN NO EVENT SHALL EXPRIA LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, PROFITS, OR DATA.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE APPLICABLE PURCHASE.
11. Dispute Resolution
11.1. Informal Resolution
Before pursuing formal legal action, you agree to contact us about any disputes and attempt to resolve the matter informally. We are committed to working with our customers to find reasonable solutions.
11.2. Governing Law
These Terms shall be governed by the laws of Texas, USA, without regard to its conflict of law principles.
11.3. Venue
Any legal action arising out of these Terms shall be filed exclusively in the courts located in Texas, USA.
12. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full effect.
13. Business Capacity Limitations
Expria LLC is a small business with limited capacity. All items are created by a single artisan, which affects our ability to:
- Accept rush orders during busy seasons.
- Process large volumes of orders simultaneously.
- Meet unrealistic deadlines, especially for graduation stoles.
- Offer warranties or guarantees that larger businesses might provide.
We are transparent about these limitations and commit to clear communication about our capabilities.
14. Changes to These Terms
We may modify these Terms at any time by posting updated Terms on our website. Your continued use of our Services after such changes constitutes acceptance of the modified Terms.
